https:\/\/youtu.be\/W5P8srM2crs<\/a><\/u><\/strong><\/p>\n\u00a0<\/strong><\/p>\n[As Delivered]<\/strong><\/p>\n\u00a0<\/strong><\/p>\n18 December 2023<\/strong><\/p>\n\u00a0<\/em><\/p>\nYour Excellency, Jose Javier De la Gasca, Permanent Representative of Ecuador, and President of the Security Council,<\/em><\/p>\nYour Excellency, Paula Narvaez, Permanent Representative of Chile, and President of the Economic and Social Council,<\/em><\/p>\nMadame Special Representative of the Secretary-General for Haiti, Ms. Mar\u00eda Isabel Salvador,<\/em><\/p>\nExcellencies, Distinguished Delegates,<\/em><\/p>\nAs you would be aware, I undertook an official visit to Haiti on 20-21 November<\/strong> \u2013 one visit that I am convinced was immensely important, not only for the Ä¢¹½ÊÓƵ Membership but to me personally as Haiti is a member of the Caribbean community, CARICOM, of which Trinidad and Tobago is a founding member.<\/p>\nUpon my return \u2013 and having reflected on what I witnessed and heard \u2013 I felt a heavy duty of responsibility to organize this exceptional informal briefing to afford me an opportunity to share with you my feedback from this important visit.<\/p>\n
Very often I hear the encouragement by the Member States for the President of the General Assembly to ensure coordination with the Presidents of the Security Council and ECOSOC \u2013 within the confines of our respective mandates.<\/p>\n
This encouragement has been echoed, among other platforms, in the debates on the revitalization of the General Assembly and most recently, during the Gayap Dialogues<\/em><\/strong> that I have organized during the 78th <\/sup>Session. In this regard, I am delighted to inform you that I have already initiated the monthly meetings with the Presidents of the two bodies.<\/p>\nToday I also have the pleasure to be joined by my colleagues the President of the Security Council and the President of ECOSOC.<\/p>\n
I sincerely thank them for accepting my invitation to join this informal briefing \u2013 and I look forward to hearing their insights.<\/p>\n
Importantly, today\u2019s informal briefing is not only an occasion to showcase the fact that \u2013 if we really mean it \u2013 there can in fact, be coordinated action among the three main Principal Ä¢¹½ÊÓƵ Organs \u2013 the General Assembly, the Security Council, and ECOSOC.<\/p>\n
This informal briefing also offers my colleagues and I the opportunity to demonstrate collaborative leadership by the GRULAC Member States<\/strong> \u2013 on an issue so critical to our region \u2013 as GRULAC Permanent Representatives are concurrently holding the Presidencies of these Principal Organs during the month of December.<\/p>\nIt would be remiss, on my part, not to express my heartfelt appreciation to the Permanent Representative of Haiti, His Excellency, Mr. Antonio Rodrigue,<\/strong> and the Government of Haiti for facilitating the visit, and for their warm reception and generous hospitality.<\/p>\nMy appreciation also goes to the SRSG, Ms Salvador <\/strong>and her team, as well as Ä¢¹½ÊÓƵ Country team family in Haiti \u2013 without whose enthusiastic support the visit would not have been possible.<\/p>\nThe main objective of my visit was three-fold:<\/p>\n
\n- First<\/strong>, to demonstrate solidarity with the Haitian leadership, and the people of Haiti; and to reassure them that the international community has not abandoned them – in their very challenging circumstances.<\/li>\n
- Second<\/strong>, to shine a brighter spotlight on the multifaceted political, security and humanitarian crises gripping the country, in order to spur meaningful action by the United Nations and the international community at large \u2013 as also called for by many leaders during the General Debate in September, especially from my own region.<\/li>\n
- And third<\/strong>, to engage first-hand with the Haitian political leaders, civil society representatives and other key stakeholders; to encourage their commitment to national reconciliation and mutual dialogue \u2013 paving the way forwards toward free, fair, credible, and inclusive elections and the restoration of the rule of law and democratic institutions that enjoy the confidence of the Haitian people.<\/li>\n<\/ul>\n
In this context, I am delighted to report that \u2013 on the side of the interim Government \u2013 I had very productive bilateral meetings with:<\/p>\n
\n- Prime Minister Ariel Henry.<\/li>\n
- Foreign Minister Jean Victor G\u00e9n\u00e9us.<\/li>\n
- Justice Minister Emmelie Proph\u00e8te Milc\u00e9, and<\/li>\n
- Women\u2019s Affairs Minister, Sofia Lor\u00e9us.<\/li>\n<\/ul>\n
In addition, I took the opportunity of my visit to join a working lunch kindly hosted by SRSG Salvador which included the President of the High Transition Council, Madame Mirlande Manigat<\/strong> \u2013 also former First Lady of Haiti, who still wields the respect of many Haitians.<\/p>\nI also had an opportunity to engage with representatives of the various political parties \u2013 in one meeting \u2013 as well as separately with Haitian civil society representatives.<\/p>\n
On the United Nations side, I held substantive meetings with the Ä¢¹½ÊÓƵ Country Team, which also featured the SRSG and her Deputy \u2013 and I am delighted that SRSG Salvador has accepted my invitation to offer some remarks at this briefing, virtually.<\/p>\n
SRSG and her team, and DSS representative as well as the Country Team did not only share with me the substantive work they are forcefully doing; but I was also appraised of the overall security situation in the country and the provincial\/regional security levels \u2013 as per the established security operating standards.<\/p>\n
\n
Distinguished Colleagues,<\/em><\/p>\nIf there was one single and dominating keyword that emerged in all<\/strong> of my conversations, it is security<\/strong>.<\/p>\nThe lack of security \u2013 due to the prevalence of the harrowing terror unleashed by the marauding gangs \u2013 clearly impacts every<\/strong> aspect of the daily lives of the Haitian people.<\/p>\nUncontrollable violence has robbed \u2013 and continues to rob \u2013 the Haitian people of their freedoms and rights; and it is stifling the country\u2019s path to sustainable development.<\/p>\n
I heard depressing accounts about schools housing people internally displaced by gang violence \u2013 and these institutions are supposed to be bastions of education, not shelters.<\/p>\n
I heard sad incidents of parents kidnapped for ransom while taking their children to school.<\/p>\n
I heard alarming reports of the loss of some 40% — I repeat, 40%<\/strong> — of Haiti\u2019s health care workers, who have left the country in hopes of finding a brighter future elsewhere.<\/p>\nI head of the brain or skills drain, of security and law enforcement personnel \u2013 who should be securing Haiti \u2013 migrating in droves for better paying jobs elsewhere.<\/p>\n
And devastatingly, I was deeply moved to hear about women and girls subjected to brutal sexual violence \u2013 with many living in a cycle of fear and trauma.<\/p>\n
It is with great sadness \u2013 and anger<\/strong> \u2013 that I recount these reality encounters to you today.<\/p>\nThis violence in Haiti clearly needs to stop \u2013 <\/strong>and we cannot be credible, as the Ä¢¹½ÊÓƵ and the international community, to just look the other way.<\/p>\nThese issues cut to the very heart of the Ä¢¹½ÊÓƵ\u2019s founding mission \u2013 to save succeeding generations from the scourge of war.<\/p>\n
In Haiti, war is in the streets \u2013 with people fighting against<\/strong> hunger, preventable disease, and unjustifiably rampant and deadly insecurity.<\/p>\nThey are equally fighting for<\/strong> a safer, more just, and prosperous life for themselves and their children.<\/p>\nThey are fighting to provide quality education<\/strong> for their children and youth \u2013 just like any other parent would do and wish for their children.<\/p>\nNonetheless, I was heart warmed when I paid a visit to a school and saw hope in the faces of the pupils, I met at \u00c9cole Nationale R\u00e9publique des \u00c9tats Unis d\u2019Am\u00e9rique<\/em><\/strong>. Indeed, this was a highlight of my trip \u2013 as the boys and girls embodied the unbridled potential within all of us to build a better world.<\/p>\nAs I have decided to do during my visits, I have donated copies of the Ä¢¹½ÊÓƵ Charter to the school<\/strong> \u2013 hoping it will inspire curiosity among these children to remain hopeful that all is not lost, because the United Nations is here to support and stand with them to achieve a better future.<\/p>\nExcellencies,<\/em><\/p>\nIt bears repeating: The deployment of the Multinational Security Support Mission authorized by the Security Council on 2 October is awaited with great urgency<\/strong> by many in Haiti, including the political parties and Civil Society groups.<\/p>\nBecause the 28 November report by the Ä¢¹½ÊÓƵ Human Rights Office and the Ä¢¹½ÊÓƵ Integrated Office in Haiti <\/strong>finds that the gangs not only control 80%<\/strong> of Port-au-Prince, the capital.<\/p>\nThey have spread even further to rural areas previously considered safe \u2013 killing, raping, kidnapping, and destroying property.<\/p>\n
I express my deepest thanks to the Government of Kenya for demonstrating leadership of this critical mission, as well as all other countries that have pledged or are planning to contribute to this peace and security initiative.<\/p>\n
I am encouraged by the coordinated preparations among the countries involved \u2013 as this is absolutely vital to achieving an effective outcome for such a delicate mission.<\/p>\n
As this mission prepares to deploy, it is equally important that Haiti\u2019s civil and political actors intensify efforts to find a sustainable political solution that will allow for the restoration of democratic institutions<\/strong> \u2013 and thus create a space for this mission to fulfil its intended role.<\/p>\nI emphasized the importance of this point during my visit, in all<\/strong> my meetings with stakeholders in Haiti.<\/p>\nI encouraged the authorities, as well as representatives of Haiti\u2019s political parties and civil society representatives, to surmount their differences \u2013 emphasizing that every stakeholder has a duty to work for the interests of the country and the people.<\/strong><\/p>\nThroughout my engagements, I reiterated the vital need to involve women and young people \u2013 especially girls \u2013 in an inclusive political processes, as their views are foundational<\/strong> to ensuring the establishment of a functioning governance system.<\/p>\nLastly, I did not mince my words in categorically challenging the Haitian political elites to abandon their self-centred pre-occupation and to prioritize <\/strong>instead the ordinary people of Haiti, who have endured too much turmoil and who deserve to be given a chance, to succeed. I emphasized that Haiti belongs to them too and that it is their responsibility as elites seeking office to fix the country so that young Haitians would be guaranteed a life chance.<\/p>\nIt was also underscored that solutions need to be homegrown Haitian solutions, with no impositions from outside, and the Ä¢¹½ÊÓƵ and the international community would be there to support and accompany the Haitian people along the way to sustainable development.<\/p>\n
\n
Excellencies, Distinguished Delegates,<\/em><\/p>\nAs I conclude, I must say, however, that I returned from Haiti also with hope; and with the full knowledge that \u2013 while Haiti is facing extraordinary challenges \u2013 its future holds indomitable promise.<\/p>\n
Driving in the streets of Port au Prince, I saw visible signs of hope<\/strong> \u2013 sustained by the undying resilience and perseverance of the Haitian people \u2013 who seem to create inventive ways to meet the daily challenges.<\/p>\nHaiti is not hopeless<\/strong>. There is, in my view, no shortage of potential in Haiti \u2013 and it is not too late that, as the international community, we must do something to accompany the Haitian people, further.<\/p>\nAs we just marked the 75th<\/sup> anniversary of the Universal Declaration of Human Rights last week, we must never forget that the rights and freedoms outlined therein are intrinsic to us all<\/strong>.<\/p>\nAs a citizen of Trinidad and Tobago, this fact resonates so loud with me \u2013 at a deeply personal level. Haiti is an integral member of the Caribbean Community (CARICOM).<\/p>\n
And, more importantly, the people of the Caribbean \u2013 have extraordinary admiration for the Haitian people, rooted in its pioneering and proud history of self-determination and independence.<\/p>\n
I came away thinking that the international community must continue to show Haitian and other regional leaders that they are not alone in their concerns and commitment to the future of Haiti.<\/p>\n

As Delivered<\/i><\/i><\/p>\r\nPresident of the International Criminal Court, Judge Piotr Hofmanski,<\/i><\/i>\r\n\r\nExcellencies,<\/i>\r\n\r\nDistinguished Delegates,<\/i>\r\n\r\n\u00a0<\/i>\r\n\r\nToday we gather to consider the annual report of the\u00a0International Criminal Court (ICC) \u2013 a\u00a0 critical pillar of the international legal order.\r\n\r\nThe ICC stands as a perennial symbol of our shared commitment to justice and humanity\u2019s greatest aspirations.\r\n\r\nIt serves as an emphatic reminder that\u00a0no one \u2013 I repeat, no one \u2013 should be exempt from accountability for the most serious crimes of concern to the international community,\u00a0and that regardless of their status, position or location, perpetrators of such crimes will invariably face the weight of justice.\r\n\r\nIndeed, when it comes to the most egregious crimes against humanity,\u00a0 accountability knows no exceptions and justifiably so.\r\n\r\nIn those grave and heinous cases \u2013 when national legal systems prove unable or unwilling to bring perpetrators to justice \u2013 the ICC must step in.\r\n\r\nAccordingly, the ICC stands as a testament to our unshakeable resolve to end impunity, and moreover, to deter others from the commission of such crimes in the future.\r\n\r\nThe Court is indeed a truly unique embodiment of our collective resolution to upholding the principles of justice and accountability.\r\n\r\nI express my\u00a0 fulsome appreciation to the Court for its diligent efforts,\u00a0 as indeed to its judges and its prosecutor, as well as to the dedicated staff who have laudibly committed themselves to the pursuit of justice \u2013 and indeed, to what is\u00a0right<\/i>.\r\n\r\nThe report highlights both the progress and the challenges faced by the ICC this year, specifically as regards the prevention and punishment of genocide, war crimes, crimes against humanity, and the crime of aggression.\r\n\r\nThese principles are fundamental to our global vision of peace and are integral to our mission of maintaining international peace and security, promoting respect for human rights, and delivering justice to those who have suffered the gravest injustices.\r\n\r\nLadies and Gentlemen,<\/i>\r\n\r\nWe must acknowledge that the Court operates in a multifaceted international landscape.\r\n\r\nIts jurisdiction spans cases where state parties have brought situations to the attention of the Court, including situations referred by the United Nations Security Council.\r\n\r\nWhile it may present a unique set of challenges \u2013this duality in referral mechanisms underscores the importance of international cooperation.\r\n\r\nDespite these challenges, the hope for universal ratification of the Rome Statute, and the Kampala amendments, serve as a profound affirmation of the ICC's enduring commitment to justice.\r\n\r\nAs more countries join and support the ICC, the bold ambition of ending impunity for the most serious crimes becomes increasingly realistic to achieve.\r\n\r\nAs we engage in this discussion, let us remember the voices of the victims, whose suffering must compel us to take meaningful action.\r\n\r\nI underscore the\u00a0need for universal cooperation with the court among Ä¢¹½ÊÓƵ Member States in our common pursuit of a more just and peaceful world.\r\n\r\nI call upon States to support the ICC where it faces constraints in its pursuit of justice, including predictable funding to effectively undertake its investigations and prosecutions.\r\n\r\nIn line with the fundamental principle of complementarity, States should cooperate\u00a0with the ICC and with each other in investigations and prosecutions, including by sharing information and evidence to uphold the rule of law and ensuring accountability for the most serious crimes.\r\n\r\nLet us remain committed to strengthening the international legal framework and ensuring that the ICC continues to fulfill its essential role in our global efforts to prevent impunity and injustice and to promote lasting peace.\r\n\r\nI thank you and look forward to a fruitful discussion on this important
