Revenues derived from Palestine refugee properties
Report of the Secretary-General
1. The present report is submitted in pursuance of General Assembly resolution 37/120 H of 16 December 1982, entitled “Revenues derived from Palestine refugee properties”, the operative paragraphs of which read as follows:
“The General Assembly,
“…
- “1. Requests the Secretary-General to take all appropriate steps, in consultation with the United Nations Conciliation Commission for Palestine, for the protection and administration of Arab property, assets and property rights in Israel, and to establish a fund for the receipt of income derived therefrom, on behalf of their rightful owners,
- “2. Calls once again upon the Governments concerned, especially Israel, to render all facilities and assistance to the secretary General in the implementation of the present resolution,
- “3. Requests the Secretary-General to report to the General Assembly at its thirty-eighth session on the implementation of the present resolution.”
2. On 25 February 1983, in accordance with established procedure, the relevant provisions of resolutions 37/120 A to K were brought to the attention of the Chairman of the United Nations Conciliation Commission for Palestine.
3. Similarly, on 16 March 1983, the Secretary-General brought to the attention of the Government of Israel those resolutions. In particular, in the light of paragraph 2 of resolution 37/120 H, the Secretary-General requested Israel to communicate to him as soon as possible and preferably by 30 June any information it could provide on the implementation of the provisions contained therein.
4. On the same date, the Secretary-General sent a note verbale to all other Member States and non-Member States drawing their attention to the relevant provisions of resolutions 37/120 A to K, including paragraph 2 of resolution 37/120 H, and requested information in regard to their implementation.
5. In the absence of a reply from Israel or from any other State, the Secretary-General sent a note verbale dated 26 July 1983 to all Member States and non-Member States once again drawing attention to the relevant provisions of resolution 37/120 H and requesting information on its implementation.
6. A reply dated 26 August 1983 was received from Israel, covering various aspects of resolutions 37/120 A to K. In the portion of the reply relating to resolution 37/120 H, “Revenues derived from Palestine refugee properties”, Israel stated that the position of the Government regarding that matter had been set out fully by the representative of Israel in the Special POlitical Committee of the General Assembly on 10 November 1981 (A/SPC/36/SR.28, paras. 5-7)
