Ä¢¹½ÊÓƵDT noted that the procedure to be followed for the given position to be re-titled and re-classified had not been completed by the time the Applicant submitted her request to the Ä¢¹½ÊÓƵDT. Ä¢¹½ÊÓƵDT concluded that no administrative decision had yet been made by the time the request for suspension of action was submitted to Ä¢¹½ÊÓƵDT and considered by same. Ä¢¹½ÊÓƵDT therefore held that the request had to be considered inadmissible, nothing preventing the Applicant from contesting the forthcoming decision.

In view of the informal resolution of the dispute and the withdrawal of the application, there is no longer any matter for adjudication before the Dispute Tribunal and the case is closed.

Pursuant to articles 2.1 and 3.1 of the Statute of the Ä¢¹½ÊÓƵDT, the status of staff member is a necessary condition for access to the Tribunal. This is in line with General Assembly resolution 63/253 which intentionally limited the Tribunal¡¯s jurisdiction. In this case, the application is not receivable ratione personae since the applicant never became a staff member. The applicant¡¯s references to provisions of the Charter of the United Nations are without merit in this respect.

It follows that the applicant has no access to the system of administration of justice in its present state. It is noted that the General Assembly has requested the Secretary-General to investigate the option of granting access to non-staff personnel. Outcome: the application was rejected.
