Ä¢¹½ÊÓÆµAT held that it would not lightly interfere with the Ä¢¹½ÊÓÆµDT¡¯s exercise of its jurisdictional powers, conferred on Ä¢¹½ÊÓÆµDT by its Statute, which enables cases to be judged fairly and expeditiously. Ä¢¹½ÊÓÆµAT held that the complaints made by the Secretary-General fell squarely within the jurisdiction and competence of Ä¢¹½ÊÓÆµDT, notwithstanding the alleged breach of procedural fairness. Ä¢¹½ÊÓÆµAT held that the appeal was not receivable. Ä¢¹½ÊÓÆµAT dismissed the appeal and affirmed the Ä¢¹½ÊÓÆµDT judgment.

The Applicant filed a request for suspension of action of the decision that she would have to take a break in service. Ä¢¹½ÊÓÆµDT issued its judgment granting the suspension of action since the three conditions stipulated in Article 2. 2 Ä¢¹½ÊÓÆµDT Statute were met. The Secretary-General appealed.

In general, only appeals against judgments of the Ä¢¹½ÊÓÆµDT concerning matters of substance are receivable. Appeals against decisions taken during Ä¢¹½ÊÓÆµDT¡¯s proceedings are non-receivable save in circumstances where the Ä¢¹½ÊÓÆµDT has exceeded its jurisdiction or competence.
