Since the applicant was not a staff member of Ģ��ƵOV when the contested decision was taken, the decision to bar him from access to the VIC did not affect and could not have affected his terms of appointment. The decision could be contested neither before the JAB nor before the Ģ��ƵDT.

Decision Contested or Judgment/Order Appealed

The application deals with the decision taken by Ģ��ƵOV to bar the applicant from access to the Vienna International Centre (VIC) in October 1999. The applicant was a former staff member of Ģ��ƵOV and he held a Special Service Agreement (SSA) with Ģ��ƵIDO at the time the decision was taken. The applicant initiated arbitration proceedings challenging the contested decision (the recourse provided for in the SSA), which resulted in a settlement of the dispute. In 2008, the applicant contested the same decision before the former JAB; his case was transferred to Ģ��ƵDT in July 2009.
