The Ä¢¹½ÊÓƵAT held that the issues on appeal were whether the Ä¢¹½ÊÓƵDT erred in refusing to grant anonymity to the staff member in proceedings challenging a written reprimand, whether it misapplied the jurisprudence governing anonymization, and whether such an error justified interlocutory review. It recalled that interlocutory appeals are receivable only in rare and exceptional circumstances, including where an error is irremediable by a final judgment and it would be manifestly unreasonable for the impugned order to remain in effect.

The Ä¢¹½ÊÓƵAT found that the Ä¢¹½ÊÓƵDT committed an error of law by...

The Ä¢¹½ÊÓƵAT noted that the JAB is specifically empowered to rule on a request for suspension of action which is within its jurisdiction and competence, so there was no basis for the Ä¢¹½ÊÓƵAT to consider the appeals unless and until there is a timely application from a decision on the merits. At such time, the Ä¢¹½ÊÓƵAT may consider, if appropriate, the due process issues raised in the currently appeal by the former ISA staff members.

The Ä¢¹½ÊÓƵAT noted that oral hearings would not assist the Tribunal with the fair and expeditious disposition of the case as there is no justification to hold oral hearings when...

The Ä¢¹½ÊÓƵAT noted that as per ISA¡¯s Staff Rule the Ä¢¹½ÊÓƵAT has the competence to ¡°order an interim measure to provide temporary relief to either party to prevent irreparable harm and to maintain consistency with the decision taken at the first instance level¡±. The Ä¢¹½ÊÓƵAT also has jurisdiction to order interim measures in appropriate cases arising out of an ISA dispute as is the case in Mr. Hall¡¯s Motion.

However, the Ä¢¹½ÊÓƵAT found that Mr. Hall had failed to demonstrate that relief by way of interim measures was necessary to prevent irreparable harm and to maintain consistency with the JAB¡¯s decision. Mr...

Ä¢¹½ÊÓƵAT considered seven motions submitted by Ms Rangel prior to a judgment on the merits. On the two Motions for Interim Relief, Ä¢¹½ÊÓƵAT held that Ms Rangel did not seek an interim measure for temporary relief consistent with the pronouncements of the ICJ Conciliation Committee, but rather she sought interim relief in cases where the Committee had dismissed her applications. Ä¢¹½ÊÓƵAT held that since one of the two cumulative conditions under Article 9(4) of the Ä¢¹½ÊÓƵAT Statute was not fulfilled, it did not need to further consider the second condition. Ä¢¹½ÊÓƵAT denied the requests for interim relief. On the...

Ä¢¹½ÊÓƵAT considered an interlocutory appeal by the Secretary-General. Ä¢¹½ÊÓƵAT held that Ä¢¹½ÊÓƵDT did not ¡°clearly exceed its competence or jurisdiction¡± when it temporarily suspended the administrative decision to laterally reassign the staff member as that decision did not constitute a case of ¡°appointment, promotion, or termination¡± excluded from interim relief under Article 10. 2 of the Ä¢¹½ÊÓƵDT Statute. Accordingly, Ä¢¹½ÊÓƵAT dismissed the interlocutory appeal as not receivable.

Ä¢¹½ÊÓƵAT dismissed the appeal, finding it not receivable. The Tribunal explained Ä¢¹½ÊÓƵDT decisions on applications for suspension of action are not subject to appeal, pursuant to Article 2(2) of the Ä¢¹½ÊÓƵDT Statute. The Tribunal also noted that this case did not fall under the narrow exceptions when appeals against interlocutory orders are allowed, i.e. when it is alleged that the Ä¢¹½ÊÓƵDT has exceeded its competence or jurisdiction. Ä¢¹½ÊÓƵAT did not find any excess of jurisdiction in the instant case and therefore deemed the appeal irreceivable.
