Ä¢¹½ÊÓƵAT recalled that access to the new system of administration of justice can be extended to persons who are not formally staff members but who can legitimately be entitled to rights similar to those of a staff member. Ä¢¹½ÊÓƵAT held that Ä¢¹½ÊÓƵDT did not err on the question of competence in finding that, pursuant to Articles 2. 1 and 3. 1 of the Ä¢¹½ÊÓƵDT Statute, it was limited to cases brought by staff members, former staff members or persons making claims in the name of incapacitated or deceased staff members of the Ä¢¹½ÊÓƵ. Ä¢¹½ÊÓƵAT held that the access to Ä¢¹½ÊÓƵDT and Ä¢¹½ÊÓƵAT was not recognised in the new internal justice system. Ä¢¹½ÊÓƵAT dismissed the appeal and affirmed the Ä¢¹½ÊÓƵDT judgment.

Ä¢¹½ÊÓƵAT held that the Appellant had neither standing to challenge a decision which he alleged did not comply with the stipulations of his service contract nor the right to request the implementation of an arbitration procedure before Ä¢¹½ÊÓƵDT. Ä¢¹½ÊÓƵAT considered two appeals, one by Ms S. Nourain and one by Ms A Nourain, against judgment No. Ä¢¹½ÊÓƵDT/2012/142. Ä¢¹½ÊÓƵAT dismissed Ms A. Nourain¡¯s appeal as she was not a party to the proceedings and had no standing to appeal. Ä¢¹½ÊÓƵAT held that the facts were not disputed; the misconduct had been established and so had its seriousness. Ä¢¹½ÊÓƵAT held that it could not say that the sanction of dismissal was unfair or disproportionate to the seriousness of the offences. Ä¢¹½ÊÓƵAT dismissed the appeal of Ms A Nourain as not receivable and the appeal of Ms S. Nourain on the merits.

Ä¢¹½ÊÓƵAT considered an application for revision of judgment No. 2011-Ä¢¹½ÊÓƵAT-154. Ä¢¹½ÊÓƵAT held that the new evidence was irrelevant because the case was not receivable; neither Ä¢¹½ÊÓƵDT nor Ä¢¹½ÊÓƵAT had jurisdiction to hear Mr. Sims¡¯ case. Ä¢¹½ÊÓƵAT denied the application.

Ä¢¹½ÊÓƵAT held that Ä¢¹½ÊÓƵDT had made no error in finding that as a General Service staff member at the G-5 level, the Applicant was not eligible to apply for the vacancy advertised in the JO, which was a post in the Professional category at the P-5 level and that, therefore, the disputed decision had no legal consequences affecting him and no effect on his rights and terms of employment.
